These Terms of Service (the "Terms") govern access to and use of the Ladder Financial portal at portal.ladderfinancial.us, the Ladder Financial lead wallet, and the related services (together, the "Services") provided by Ladder Financial LLC, an entity organized in Utah, doing business as Ladder Financial ("Ladder Financial," "we," "us," or "our"). The Services are offered only to licensed insurance professionals and their businesses in the United States.
By creating an account, signing in, funding a lead wallet, purchasing or receiving a Lead, or otherwise using the Services, you agree to these Terms, the Ladder Financial Privacy Policy, and the Ladder Financial Agent Lead Agreement. The Agent Lead Agreement controls any conflict with these Terms, including payment, Lead data, confidentiality, intellectual property, warranties, liability, indemnification, termination, notices, and dispute resolution. If you do not agree, do not use the Services. If you accept for an agency, company, or other organization, you represent that you have authority to bind it, and "you" includes that organization and its authorized users.
Ladder Financial operates a portal through which you can fund a prepaid lead wallet, set delivery preferences such as states, product lines, and daily caps, receive consumer insurance inquiries ("Leads") in real time, view the consent evidence attached to each Lead, and review your wallet ledger and delivery history. Ladder Financial may also send delivery notifications by email or text, and may forward Leads to a destination you connect, such as your own CRM. Ladder Financial may add, change, or retire features over time.
The Services are for business use only. You represent that you are at least 18 years old, are acting for a legitimate United States business, hold and will maintain every insurance license, appointment, and registration required for each state and product line you select, and will use the Services only for lawful business purposes.
You must provide accurate, current, and complete account, contact, licensing, and payment information and keep it updated. You are responsible for safeguarding your login credentials, for every action taken under your account, and for the conduct of any authorized user you add. Notify prestonpackardffl@gmail.com promptly if you suspect unauthorized access. Ladder Financial may refuse, suspend, or close an account that violates these Terms or presents a legal, security, payment, or reputational risk.
A Lead is contact information and related details about a consumer who requested information about insurance or a related product. A Lead is delivered when Ladder Financial makes it available in your portal, sends it to you or an authorized user, or transmits it to a destination you selected. Ladder Financial or its suppliers may apply phone, one-time-passcode, identity, duplicate, fraud, and consent verification before delivery. Verification confirms that a stated step occurred; it does not guarantee that the consumer will answer, qualify, apply, purchase, or remain a customer, or that any information will stay accurate. Lead availability varies. Daily caps and delivery preferences are maximums, not volume commitments. Leads are consumer inquiries, not appointments, applications, or policies, and Ladder Financial makes no promise about contact rates, conversion, premium, revenue, or return on investment.
Once a Lead is delivered you control how you contact and work it. You are solely responsible for your calls, texts, emails, recommendations, illustrations, sales practices, and insurance activity, and for compliance with the Telephone Consumer Protection Act, national and internal Do-Not-Call rules, CAN-SPAM, state telemarketing and privacy laws, insurance licensing and advertising rules, carrier and upline requirements, and every other applicable requirement. You will use Lead data only for lawful follow-up concerning the consumer's inquiry, protect it with reasonable safeguards, limit access to authorized personnel, honor applicable consumer requests, and report any suspected security incident to prestonpackardffl@gmail.com without delay. Consent evidence, delivery notes, and any templates or guidance Ladder Financial provides are informational and are not legal, compliance, tax, or insurance advice.
If you connect a CRM, calendar, webhook, or other third-party destination, Ladder Financial will send Lead and delivery data to it at your direction. You are responsible for that destination, for the rights and consents needed to use Lead data there, and for the third party's own terms and privacy practices. Ladder Financial does not control third-party services and is not responsible for their availability or conduct.
You agree to pay the amounts disclosed to you at checkout and in your account, which may include:
Payments are processed by a third-party payment processor. By saving a payment method you authorize Ladder Financial and its payment processor to store it and to charge it for the membership fee (if any), the wallet funding you select, and any automatic refill you enable, according to the amounts and schedule disclosed in your account. You may turn off future automatic refills and cancel future membership renewals through your account or by writing to prestonpackardffl@gmail.com. Turning off a refill does not reverse a completed charge. Membership cancellation requires a separate remaining-wallet acknowledgment and disables automatic refill and new wallet funding. After the processor confirms cancellation of future renewals, eligible delivery can continue using the remaining prepaid wallet, including after membership expiry, until available funds cannot cover the next delivery. Other account and delivery requirements still apply. Already submitted payments and delivered-lead settlements may finish; any remainder stays on the ledger. Cancellation does not refund or reset the wallet. Contact Support to rejoin. The processor may retry a failed authorized payment through its ordinary process. Wallet funds are prepaid credit for Leads and Services only; they are not a deposit, earn no interest, are non-transferable, and have no cash value outside Ladder Financial. Except for a confirmed mechanical billing or delivery error, membership fees, wallet funding, and Lead Charges are final. The Agent Lead Agreement describes Lead Rates, variable-pricing authorization, holds, settlement, and corrections in detail and controls if it conflicts with these Terms.
Variable-rate Leads do not include replacement rights. A disconnected number, non-response, lack of interest, inaccurate consumer statement, disqualification, missed appointment, declined application, or failure to purchase is not grounds for a replacement, refund, or credit. If Ladder Financial confirms that it charged the same delivery twice, delivered to the wrong account, or made another mechanical billing or delivery error, Ladder Financial may correct your wallet ledger. Contact prestonpackardffl@gmail.com with the Lead and delivery details; a correction is not a quality replacement.
Before initiating a chargeback or payment dispute, you agree to contact prestonpackardffl@gmail.com and allow a reasonable opportunity to investigate. An unauthorized or abusive chargeback is a material breach. Ladder Financial may pause Lead delivery or portal access immediately for an unpaid membership charge (if any), insufficient wallet balance, a failed authorized refill, a chargeback, suspected fraud or unlawful activity, a security risk, or a material breach. You may stop using the Services at any time and may cancel future membership renewals and automatic refills through your account or by writing to prestonpackardffl@gmail.com. Termination does not refund completed charges or unused wallet credit except where the Agent Lead Agreement or applicable law requires, and does not excuse amounts already incurred. Sections that by their nature should survive, including payment obligations, disclaimers, limitation of liability, indemnification, and dispute resolution, survive termination.
Ladder Financial and its licensors retain all rights, title, and interest in the portal, software, designs, trademarks, logos, pricing methods, data models, and all other intellectual property in the Services, other than your own content and data. You receive a limited, non-exclusive, non-transferable, revocable license to use the Services for your internal business purposes while your account is in good standing. You will not copy, modify, scrape, reverse engineer, or create derivative works of the Services, remove proprietary notices, use Ladder Financial's name or marks without written consent, or use non-public information or methods to bypass the Services or build a competing system.
The disclaimers in Section 13 of the Agent Lead Agreement apply to the Services.
Section 15 of the Agent Lead Agreement governs limitations of liability, including its exclusions and exceptions.
Section 14 of the Agent Lead Agreement governs indemnification, including defense and settlement procedures and the provider's intellectual-property indemnity.
Section 17 of the Agent Lead Agreement governs governing law, dispute resolution, arbitration, opt-out rights, and venue for the Services and these Terms. These Terms do not create a separate arbitration opt-out period. Notices follow Section 18.1 of the Agent Lead Agreement.
Ladder Financial may update these Terms prospectively. The "Last Updated" date will change, and a material change will receive a new version that you will be asked to accept before further purchases or delivery. Changes and electronic acceptance are subject to the Agent Lead Agreement. Continued use alone does not replace required acceptance of a material change.
Your electronic acceptance is your signature. Ladder Financial may retain the version accepted, your account and user identifiers, email, timestamp, IP address, user agent, checkout disclosures, and payment and wallet authorizations as records of acceptance and may produce them in any dispute.
